PROCEDURE OF FILING AND CONSIDERATION OF A

TRADEMARK APPLICATION

   According to the Georgian Trademark Law the following documents must be attached to the trademark application:
   1) 12 copies of a trademark
   2) List of goods/services in accordance with the international classification
   3) Power of Attorney
   4) Document certifying payment of official fee for the formal examination
   List of goods/services can be filed in foreign language providing that within one month it will be translated into Georgian. Power of Attorney and the document certifying payment of the formal examination can be filed within one month from the filing date.
   After that within two months the Patent Office carries out the formal examination and issues priority document with indication of the priority date.
   After completion of the formal examination within three months official fee for the substantive examination and the publication must be paid.
   The Patent Office carries out the substantive examination within six months after completion of the formal examination.
   If the Patent Office takes favorable decision with respect to the application, information about the application is published in the official industrial property bulletin.
   If within three months from the date of publication the Patent Office receives no objections regarding registration of the mark, it issues notification according to which official fee for registration and maintenance in force within 10 years must be paid.
   After payment within one month the Patent Office issues the certificate of registration.
